These General Terms and Conditions of Contract and Use apply to visitors to the website www.casadamendoeira.pt (hereinafter “User”) as well as to any commercial transactions carried out by the Customer through the online store at www.casadamendoeira.pt.
Browsing the website, as well as purchasing any product from the online store at www.casadamendoeira.pt, implies acceptance of these General Terms and Conditions of Contract and Use by the User and the Customer.
Casa D’Amendoeira reserves the right to modify these General Terms and Conditions of Contract and Use without prior notice, with any changes published on the website www.casadamendoeira.pt.
INFORMATION ABOUT CONTENT
Casa D’Amendoeira reserves the right to modify at any time the information and commercial offers presented regarding: products, prices, promotions, and commercial terms.
The use of the domain www.casadamendoeira.pt for abusive purposes, and without prior authorization, is subject to legal action by Casa D’Amendoeira. In the event that you find links on other websites that allow you to access www.casadamendoeira.pt, please be advised that Casa D’Amendoeira assumes no responsibility for the origin of the page or the content contained therein.

LIABILITY AND FORCE MAJEURE
All Products sold on the website www.casadamendoeira.pt comply with Portuguese law.
Casa D’Amendoeira disclaims any liability in the event of a violation of the laws of the country where the order is delivered. It is the Customer’s responsibility to verify with local authorities the import or usage conditions for the Products they intend to order.
Casa D’Amendoeira is not liable for damages resulting from any interference, interruptions, computer viruses, malfunctions, or disconnections of the operating system that may temporarily prevent access, navigation, or the provision of services to Users.
Casa D’Amendoeira is not liable for any misuse of the User’s website access credentials by third parties, as these are personal and non-transferable.
OBLIGATIONS OF CUSTOMERS AND USERS
The Customer and the User agree to comply with and respect these General Terms and Conditions of Contract and Use, namely:
To refrain from entering, storing, or disseminating through the website content that is defamatory, obscene, offensive, xenophobic, and/or of any other nature that violates general principles of law and public order;
To keep their website login password secure and not disclose it, in order to prevent third parties from accessing their account at www.casadamendoeira.pt;
Not to use false identities;
To provide accurate personal data and addresses so that Casa D’Amendoeira can properly process orders.
Users are therefore expressly prohibited from transmitting messages or information that is offensive, misleading, defamatory, obscene, or that violates, in any way, the right to privacy or the intellectual or industrial property rights of third parties, as well as from making available any information that may be harmful to third parties or to the website owner.
Casa D’Amendoeira reserves the right to delete the account of any user who fails to comply with any of the aforementioned Obligations.
The Customer is responsible for the accuracy of the data provided to Casa D’Amendoeira and agrees to immediately update their Casa D’Amendoeira Registration Account on the website www.casadamendoeira.pt with any changes to said data.
Casa D’Amendoeira declines any responsibility for any delay or inability to process the order, particularly at the time of delivery, resulting from an error or insufficiency in the data provided by the Customer.
PLACING ORDERS ONLINE
To make purchases through the website www.casadamendoeira.pt, you must register as a Customer by creating a personal account and filling out the registration form. Once registered, simply add all the items you wish to purchase to your virtual shopping cart. You must follow all the steps of the purchase process to ensure it is successfully completed.
To place an order, the Customer must be at least 18 years old (or have parental permission to shop at Casa D’Amendoeira).
Confirmation of the purchase order implies that the Customer has read and expressly accepts these General Terms and Conditions of Contract and Use, available for review on the website www.casadamendoeira.pt.
The User will receive an order confirmation email with details regarding the payment method selected. If you do not receive it, the Customer should check their email spam folder or contact Casa D’Amendoeira.
As soon as you complete your purchase, you will receive an automatic email confirming the transaction. If the information is incorrect, you may immediately request a correction or even cancel the purchase.
When purchasing Products sold on www.casadamendoeira.pt, Casa D’Amendoeira accepts the following payment methods:
Casa D’Amendoeira authorizes its current partner to process the payments received, or any other party it may engage for the same purpose, in its stead.
Casa D’Amendoeira reserves the right to refuse and cancel orders that have already been confirmed in the following situations:
The information on the invoice is the sole responsibility of the Customer. Once issued, the invoice cannot be altered.
If you order multiple products and one is on pre-order, all products will be shipped together at a later date. However, you may request separate shipments to receive available products by contacting info@casadamendoeira.pt. All shipping costs associated with separate shipments will be borne by the Customer.
PRICES
The prices of products displayed on www.casadamendoeira.pt are exclusive of VAT.
All prices are quoted in euros (€). A change in the delivery country may affect prices due to varying shipping costs. Customs fees related to the order’s delivery country will be borne by the Customer.
The prices of products displayed on the website are subject to change. Casa D’Amendoeira reserves the right to change prices without prior notice. The prices displayed at the time of purchase are the prices applied to that purchase.
If there is an error in the price of the requested products, Casa D’Amendoeira or the Customer may cancel the order until the order is shipped.
The total price specified at checkout includes taxes from the country of origin (Portugal) and shipping costs.
The Customer must pay only the amount specified in the order confirmation.
Please note that: although personalized products have a longer delivery time, payment will be processed immediately after your order is placed.
Personalized products have a different price, as they are developed exclusively for you.
The cost of personalization is determined by Casa D’Amendoeira. The Customer is responsible for choosing the type of personalization they want for their products. Therefore, the price of the personalized item may vary depending on the personalization.
To obtain the most accurate customization prices, the Customer should contact Casa D’Amendoeira via email at info@casadamendoeira.pt for a quote on product customization.
The Customer’s final confirmation of the order constitutes full and complete acceptance of the prices and descriptions of the products/services available for sale on the website www.casadamendoeira.pt.
Adding a product to the “Wishlist” does not guarantee reservation at a specific price.
Casa D’Amendoeira does not reserve products on www.casadamendoeira.pt.
SHIPPING COSTS
Shipping costs will be calculated automatically at checkout.
Casa D’Amendoeira assumes no responsibility for orders with associated shipping costs and may require payment of fuel surcharges, customs duties, and other fees, depending on the country of delivery.
If the Customer chooses to refuse their order, they will be responsible for any fees, taxes, and/or customs charges incurred on the order, as well as the cost of returning the order to Casa D’Amendoeira’s address. This amount will be deducted from their purchase refund.
ORDER SHIPPING
Lost, misplaced, or damaged items, as well as delays during transport, are not the responsibility of Casa D’Amendoeira, but rather that of the carrier.
By choosing registered mail, you will have the advantage of being able to track your order at any time, in addition to being able to file a claim with the carrier.
Standard mail does not allow for order tracking, and in the event of loss, misplacement, damage, or delays, it will not be possible to file a claim. The order is shipped at the customer’s risk.
If you have entered an incorrect delivery address, please email us immediately so we can update your order, provided it has not yet been shipped.
PRODUCT INFORMATION
Casa D’Amendoeira provides information on www.casadamendoeira.pt and its subdomains regarding the essential characteristics of our products through detailed technical descriptions and photographs, in accordance with best practices for product presentation policies.
Casa D’Amendoeira will make every effort to ensure that the colors of the products appearing on the website www.casadamendoeira.pt are as accurate and true to life as possible. However, the color of the product may vary from the images shown due to the texture and color of the production materials.
Casa D’Amendoeira products are handmade, so items may not be exactly the same as those in the product photos. This is part of the handmade process, which makes Casa D’Amendoeira products unique. Casa D’Amendoeira will make every effort to ensure that the colors of the products appearing on www.casadamendoeira.pt are as accurate and true to life as possible, while maintaining the product’s overall aesthetic and its intended functionality.
PRODUCT AVAILABILITY
Casa D’Amendoeira only processes an order placed by a Customer after confirmation of the respective payment; therefore, Casa D’Amendoeira cannot guarantee the availability of items until the start of said processing.
On the product page, the Customer will find the estimated shipping date: 3–5 business days. This shipping time is due to the fact that Casa D’Amendoeira products are handmade in small batches.
Shipping time does not include transit time.
Casa D’Amendoeira ships only on business days. Therefore, weekends and holidays are not included in the estimated delivery time for orders. Estimated delivery dates are for reference only.
In the event of immediate unavailability, Casa D’Amendoeira will contact the customer if the delivery time or price of the item changes, and the order will only proceed after the customer has given their consent.
In the event of absolute stock unavailability of the ordered product, and if it is not possible to offer the Customer any product of equivalent quality and price, or if the Customer has not given consent to the modification of the order initially placed, Casa D’Amendoeira will refund the amounts paid by the Customer within a maximum of 14 (fourteen) days following notification of the cancellation.
Any delay in the shipment of items, relative to the estimated dates provided (which are merely indicative), does not entitle the Customer to any compensation.
VALIDITY OF PROMOTIONS, SALE ITEMS, DISCOUNTS, AND PROMO CODES
The offers on the website www.casadamendoeira.com are valid only at the time they are displayed on the website, unless otherwise stated on the website.
Casa D’Amendoeira honors the established offers but is not bound by any offer in the event of errors or mistakes in spelling, translation, pricing, or other information. Casa D’Amendoeira reserves the right to cancel any purchase or sale made under such errors.
RIGHT OF WITHDRAWAL
The Customer may withdraw from the contract within 14 (fourteen) days of receiving the order, provided that:

The Customer may exercise their right of free termination by sending a Free Termination form or any other unequivocal statement of termination of the contract to the email address info@casadamendoeira.pt.
The costs of returning the order when exercising the right of free cancellation are borne by the Customer.
Once the returned product is received, Casa D’Amendoeira will inspect and confirm the condition of the order, and when applicable, will refund the amounts paid by the User as listed on the order within a maximum of 14 (fourteen) business days.
Upon receipt of the return at Casa D’Amendoeira, the Customer will be refunded the amount corresponding to the amount paid for the order (sales invoice amount). If a promotional discount code was used, that amount will not be refunded; that is, the refund will only cover the amount actually paid.
If the returned items show signs of use, Casa D’Amendoeira reserves the right not to accept the return and to refuse a refund for them.
The right of free termination does not apply if the ordered products have been customized according to the User’s specifications or are clearly personalized.
The Customer should note that if the return was made for reasons other than the justified existence of a defect or non-conformity of the ordered products, Casa D’Amendoeira will not reimburse shipping costs. Therefore, Casa D’Amendoeira will not reimburse the shipping expenses initially incurred by the customer for the respective order.
Please note that these conditions apply only to orders placed in Portugal. If your order was placed outside of Portugal, please contact us via email at info@casadamendoeira.pt.
CANCELLATIONS, RETURNS, AND EXCHANGES
The Customer may cancel their order, provided they request it via email at info@casadamendoeira.pt before it is shipped.
For orders canceled before shipment, we will refund the amounts paid by the Customer, as listed on the order, within a maximum of 14 (fourteen) business days.
For orders canceled after shipment, the rules set forth in the previous section regarding the right of free termination will apply.
Failure to pay for the order within 2 days following the date it was placed will result in its automatic cancellation.
It is not possible to cancel or exchange products that have been personalized according to the Customer’s specifications, or that have been clearly personalized by the Customer on the website www.casadamendoeira.pt with errors.
Casa D’Amendoeira does not exchange personalized products. The Customer may exchange their order, provided the products are not personalized, for another product available at www.casadamendoeira.pt, with all costs related to the exchange being the Customer’s responsibility.
If the ordered product is defective or otherwise non-compliant, the Customer may choose to:
As soon as the Customer notices a defect or other non-conformity in the product, they must notify us via email at info@casadamendoeira.pt, attaching photographs documenting the situation.
As soon as we receive your email, we will contact you by phone or email to resolve the issue by mutual agreement.
Please note that returns do not apply to personalized products, as the product was made exclusively for the Customer.
APPLICABLE LAW
These Terms and Conditions, and all disputes arising in connection with them, including their validity, the use of www.casadamendoeira.pt, or any purchase made on the site, are subject to Portuguese law.
Any conflict or difference of interpretation regarding the General Terms and Conditions of Contract and Use shall be submitted to the competent authorities.
